The North Carolina Council of Chapters working with the 4th Branch and
NC Veterans Council will pursue the following legislative actions for 2011:
• Continued push to have the General Assembly pass a law to continue Equal Treatment of Government Employees (Bailey-Patton court decision)
• Establishment of a cabinet-level Department of Military Veterans Affairs
• Passage of a law that will encourage the use of military veteran contractors
While many of the State House and Senate members support the above goals, the likelihood of passage of the first two goals is unlikely in today’s economy and projected 2.6 billion dollar deficit in the current state budget. Governor Perdue will be pushing for consolidation of state agencies, therefore, the second goal is moot. Anything that takes away potential revenue even though it has the potential of generating long term revenue gains will probably not be considered during the next two legislative sessions. That being said, we must still educate our legislators about the benefits of all three goals and hope for success in the future.

Extending Bailey Settlement Initiative
The initiative to extend the Bailey Settlement was included in the Studies
Bill, HB945 which was passed last session. The bill directed the Revenue Laws
Study Committee to study six initiatives, one of which was extending the
provisions of Bailey Settlement. The committee is supposed to report out during
the 2010 legislative short session. This is not necessarily a positive step for
the initiative.

The North Carolina Council of Chapters President, COL Vern Pike USA (Ret) has
reported that despite the North Carolina the General Assembly adjourning without
favorable action on HB 345, Extension of Bailey/Patton; the
governor did sign a bill, which directs the General Assembly to study select
revenue bills during the period between full sessions and HB 345 was included as
one of the bills. That means the Economic Impact Study will be in front of both
legislators and bureaucrats in the Department of Revenue. We are hopeful that
this review will led to more favorable action by our legislators in the coming
“short session” in late April-May 2010.

North Carolina Bailey Settlement Expansion
HB 345 successfully came out of the House committee on Pensions and Retirement
and Rep. Wainwright is now listed as a co-sponsor. The Bill is now in the
Finance Committee and Representative Wainwright is one of the Chairs. The
Senate companion bill S233 is in the Senate Finance Committee also and has been
so for some time. Senator Preston is on that committee. The State
Council of Chapters should be informing the Chapter soon if further action is
neeeded.

North Carolina Bailey Settlement Expansion Action Needed
Most if not all of you are enjoying the benefits of what is commonly known as
the Bailey Settlement. It provides North Carolina Income Tax exemption on our
military retirement. The Bailey Settlement is the result of a class action legal
suite and is limited in scope. The MOAA North Carolina Council of Chapters is
partnering with the 4th Branch, State Employees Association of North Carolina
and the National Active and Retired Federal Employees Association to pursue a
statute that would exempt all resident military, federal, state and local
government retirees from paying income tax in North Carolina. This legislative
initiative was announced on the CCMOA website on January 29th and a complete
explanation of the initiative is posted below. The current economic situation is
creating unforeseen obstacles for this initiative. However it is good business.
An economic study that supports the initiative is
available here.
The CCMOA Board encourages the Chapter members to complete several actions in
support of this initiative.
The first action is to correspond with Representative Tucker, Chair of the House Pensions and Retirement Committee encouraging passage of House Bill 345. This needs to be done by 12 April 2009. We have provided a sample email and sample letter. The sample letter includes Representative Tucker’s address and his email address is Russell.Tucker@ncleg.net. If sending a letter, please send a copy to the cc address on the sample letter. If sending an email, please bc or cc newsletter@ccmoaa.org.
The second action is to thank Representative Underhill for sponsoring House Bill 345 and to encourage Representative Wainwright and Senator Preston to also sponsor the respective House and Senate bills. While there is no specific deadline for this action, it needs to be done expeditiously. We have provided sample emails and letters for each Representative and one for Senator Preston. The letters contain the appropriate General Assembly addresses. The corresponding email addresses are also listed below. Bailey Settlement Expansion
Most if not all of you
are enjoying the benefits of what is commonly known as the Bailey Settlement.
It provides North Carolina Income Tax exemption on our military
retirement.
The Bailey Settlement is
the result of a class action legal suite and is limited in scope. The MOAA North
Carolina Council of Chapters is partnering with the 4th Branch, State
Employees Association of North Carolina and the National Active and Retired
Federal Employees Association to pursue a statute that would exempt all resident
military, federal, state and local government retirees from paying income tax in
North Carolina.
This initiative is
to create new public policy that is more encompassing and long lasting than the
Bailey Settlement.
The argument for this initiative is that it is economically in the best interest of North Carolina to do so. The groups mentioned above commissioned a study of the economic impact of extending the terms of the Bailey Settlement to all government retirees. It is highly likely that you were asked to complete a questionnaire for that study. The study has been completed by an independent consultant, James L. Hendrick PHD. It, in fact, demonstrates a positive economic impact to North Carolina if the terms of the Bailey Settlement are extended as proposed.
The MOAA North Carolina Council of Chapters has asked all
chapters to actitively support this initiative and CCMOA is doing so.
Expect an email in the near future with some information about what you can do
to support this initiative. You will be hearing more this as our advocates meet
with the General Assembly.
